By visiting or shopping at this website, you are accepting all of our terms and conditions. Please read them carefully. It is YOUR responsibility to read though all terms and conditions, all return policies, and all shipping policies. Herringbone & Company will not be held responsible for you not reading or understanding anything stated on our website. If you are not clear on any of our policies, please contact us BEFORE you place your order, and we will be happy to discuss or clarify any questions.
We reserve the right to refuse service to anyone for any reason at any time. We do our best to serve our customers with the utmost respect and courtesy. We work hard to try to serve everyone and make them happy customers. However, we do not under any circumstance tolerate bullying, threats, or other rude and inappropriate behavior. We reserve the right to refuse to serve and do business with anyone who does not follow our polices or treats us, or any of our vendors in an inappropriate manner.
We reserve the right to cancel any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made.
This site is provided by Herringbone & Company on an "AS IS" basis. Herringbone & Company makes no representations or warranties of any kind, express or implied, as to the operation of the site, the information, content, materials or products, included on this site. To the fullest extent permissible by applicable law, Herringbone & Company disclaims all warranties, express or implied, including but not limited to, implied warranties of merchantability and fitness for a particular purpose. Herringbone & Company will not be liable for any damages of any kind arising from the use of this site, including but not limited to direct, indirect, incidental punitive and consequential damages. YOUR USE AND BROWSING IN THE WEBSITE ARE AT YOUR OWN RISK.
ERRORS, INACCURACIES AND OMISSIONS
Herringbone & Company makes all reasonable efforts to ensure the accuracy, correctness and reliability of the site content, however, occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order). Herringbone & Company reserves the right to correct improperly priced items at any time. In the event an improperly priced item is discovered after credit card processing, Herringbone & Company will promptly notify you by email. At that time, you can decide whether or not to accept a full refund, or continue with the order at the new revised price. If for any reason we do not hear back from you via email, we will void the sale, and issue a refund via the same method used to purchase the item.
ACCURACY OF BILLING AND ACCOUNT INFORMATION
You agree to provide current, complete and accurate purchase and account information for all purchases made on our website. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed. Any inaccurate information provided by you may result in additional fees being charged to you, including but not limited to, additional charges for delivery due to an inaccurate address given.
USER COMMENTS, FEEDBACK AND OTHER SUBMISSIONS
If, at our request, you send certain specific submissions or without a request from us you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, 'comments'), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments. We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Service. You agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false e-mail address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third-party.
PRODUCT DETAILS AND DESCRIPTIONS
We have made every effort to display as accurately as possible the colors and images of our products that appear on this website. We cannot guarantee that your computer monitor's display of any color will be accurate. Because every computer/mobile screen displays color differently, we cannot be responsible for variations between the actual product color and how it is displayed on your screen. Descriptions of merchandise, including colors, textures and other features are provided by the manufacturer. Herringbone & Company assumes no liability whatsoever for the description, for variance, including in colors or textures, minor imperfections and/or for a product not meeting with customer satisfaction, absent a manufacturer-verified defect. We offer fabric swatches and finish samples some of our vendors. Please contact a customer representative for swatch requests.
Finish Variations: Many of our custom made furnishings are made from wood, a natural living and breathing product. Nature is unique and never duplicates, making no two pieces of wood, even from the same tree, exactly alike. Because wood responds to fluctuations in humidity levels (just like hardwood flooring), furniture can expand and contract over time depending on the climate. Please note that the degree of humidity or dryness in your home may cause splitting which will not affect the structural integrity of the piece and is not to be considered defective. Certain types of wood will have more visible knots and wood grain. Our artisans make every effort to conceal knots and grain on painted finishes, but due to natural resins within some wood types (i.e. pine), they cannot completely eliminate them or guarantee to control them. Knots and grain may bleed through and slightly discolor the finish (this may be more apparent on light color finishes). This discoloration is not to be considered a defect in craftsmanship. Irregularities in the finishes are not to be considered defects. While finishes are durable, they are not indestructible. Please contact us for care and maintenance of your wood furniture. We have swatches available for many of our lines that we are happy to loan out to customers. Please note that many of our artisans and craftspeople custom mix paint for their finishes so swatch samples may vary slightly from actual finishes.
Natural Products: All items made from natural products such as but not limited to- agate, crystal, quartz, limestone, marble, alabaster and granite will have natural variations and no two will be the same. These variations should be expected and are not seen as defects.
Herringbone does not provide warranties on the products we sell. However, many of our artisans and manufacturers do, and we will act as a liaison for you to in getting your issue handled by the manufacturer of the product purchased. Because the details and duration of our manufacturers' warrantees differ, we encourage you to ask one of our customer service agents for specific warranty information on products you are interested in.
WHEN DAMAGES OCCUR DURING FREIGHT DELIVERY
While we do our utmost to ensure your items arrive in a timely manner and in perfect condition, there are some things that are beyond our control. We would like to claim that damages do not occur during transit, but unfortunately that is not always the case. Our freight carriers handle your pieces with great care but it is important to understand that from time to time damages do occur. If your piece arrives damaged, the freight company reserves the right to have the piece repaired and brought back to the manufacturer's standards at their expense. They do this by sending the piece to a furniture medic or back to the manufacturer for a repair/rebuild. If the freight carrier determines the piece cannot be repaired, you have the right to have another piece rushed at no additional charge and shipped out to you as soon as possible. Herringbone & Company and the freight company will cover the damages to the furniture piece only. We will not be held liable for any additional charges or losses incurred by you, including but not limited to, loss of deposits or money paid to other subcontractors such as electricians, moving companies, cleaning crews, photographers, real estate sales, etc.
Sometimes an IN-STOCK item may actually be OUT OF STOCK (sometimes an item may sell out before we've had a chance to update the web-site). We sell items from numerous artisans and vendors from around the country, and even internationally. While many of our vendors do keep stock of all their product, sometimes they do sell out faster than planned. We do our best to keep up with these stock changes, but due to the fact that an item could sell out within hours or days, backorders on product we sell does happen. If the item is no longer available we will do our best to notify you immediately. Herringbone & Company does it's best to ship out products in a timely manner, but we reserve the right to backorder or cancel orders at any time for any reason. You will be notified via email if part or all of your order is back ordered more than 2 weeks. Herringbone & Company will in no way be responsible for losses by customer due to scheduling of electricians, contractors, or other professional installation in relation to items arriving later than planned.
COUPONS AND DISCOUNT CODES
Occasionally Herringbone & Company will offer customers coupons and discount codes that can be used on purchases. Herringbone & Company reserves the right to restrict the use of these discounts and reserves the right to deny customers the ability to use them based on overuse, abuse, restricted timelines, etc. Coupons and discount codes cannot be combined with any other offers and cannot be used on past purchases. For any coupons or discounts offering “FREE SHIPPING”, this entitles the customer to free shipping on our basic, standard shipping only. Free shipping does not apply to rush shipping, 2 or 3 day shipping, overnight shipping, or any special freight delivery such as white glove services, in home delivery, etc. Herringbone & Company reserves the right to charge customers additional shipping and/or freight due to difficult and out of the ordinary shipping issues that may arise during the delivery of your purchase. CANCELLATIONS AND/OR CHANGES
If you need to cancel or make changes to an order you must contact us within 24 hours. Some orders ship the same day, so we need to know as soon as possible. Calling in or requesting a cancellation does not guarantee your order can be cancelled or changed as it may have already been picked or shipped out. If this is the case, and an item you ordered has already shipped, you will be required to pay for the shipping both ways as well as a restocking fee. Items listed as “NO RETURNS” or “CUSTOM ORDER”, will be in no way refunded or able to be returned after 24 hours of you placing your order. Please read the details for each product you order as return eligibility changes from product to product.
You can expect a refund in the same form of payment originally used for purchase within 15 days of our receiving your return or request to cancel your unshipped merchandise. Please understand that it takes several days for us to go through returns and to inspect them. After inspection it is sent to our credit department for processing. If accepted, a credit is given and it takes several business days for a credit to post through the credit card processor and issuing bank. All returns and exchanges will be credited less the items restocking fee and shipping costs (to and from shipping). Restocking fees vary item to item based on the manufacturer. It is your responsibility to read over the return details posted on EACH AND EVERY item you purchase. If an item was sold with free shipping, the original shipping costs incurred by Herringbone & Company will be deducted as well.
Herringbone & Company is a registered corporation in the State of California and is responsible for collecting state sales tax on all orders shipped within the state. Our shopping cart will automatically calculate this tax on all orders shipped within the State of California.
